同志權勝利 加州解除同性婚姻禁令

在美國最高法院26日撤銷婚姻為一男一女組合的法律條文之後，位於舊金山的聯邦上訴法院28日也裁定，解除加州對同志婚姻的禁令，並且是立即生效。

舊金山第九巡迴上訴法院(9th Circuit Court of Appeal)裁示，解除對加州同性婚姻的禁令，從現在開始加州必須對結婚的同志伴侶核發證書。

這項比預期還快的裁示，受到同性戀支持者的熱烈歡迎。由於最高法院26日才剛表明立場，支持者原本預期加州要採取行動還要等上一段時間。

人口在全美居首的加州，在2008年曾短暫允許同性戀者結婚，但之後舉行公投，以52%民眾贊成、48%反對的結果，通過八號提案(Prop 8)禁止同性婚姻。

2010年法官曾裁定八號提案違憲，但第九巡迴上訴法庭裁定暫緩執行判決；最高法院這個月26日裁定「八號提案」違憲，命令舊金山第九巡迴上訴法庭解除暫緩令。
