某社群網站盜用我圖片與肖像權爭議

這很簡單啊

若是沒有任何俗成約定

他可以主張肖像權，禁止你使用該宵像，但他沒法因為有宵像存在就剝奪盜用你的智慧財產權，這意思是說他可以禁止你使用有他圖像的照片，但你也可以禁止他使用你的創作，他可沒法因為你的創作有他的圖像，就可以隨意使用你的創作，除非他徹圖，不然就是百分百侵權，就算他後製，那更違反著作法未經創作人同意複製改造的權利

若是樓主有活動擔任攝影的證據，那他想主張宵像權，就得當場主張要求主辦單位拒絕你拍攝宵像，否則他們可以拒絕參加主辦單位的活動，而不是事後才談
