籃球比賽撞傷對手左眼　學生挨告不起訴

北市大同大學林姓學生（20歲）去年5月3日傍晚在校內參加籃球比賽，林男搶下籃板球後，準備轉身長傳給隊友快攻，沒想到敵對的薄姓男子貼上身後林男防守，造成林男手肘不慎撞上薄男臉部，薄男眼鏡因此破裂，左眼眼瞼裂傷、眼角膜擦傷，視力只剩0.02，薄男怒控林男過失傷害。

但北檢認為，國際籃球規則中，有所謂的圓柱體原則，也就是球員所佔周圍，有假想的圓柱體空間，檢方認為，薄男因防守而突破林男的假想圓柱體空間，造成2人身體碰撞接觸，再加上球類運動比賽激烈，運動過程中的傷害是運動員事前所容許的風險範圍，若動輒對運動員科以刑事處罰，將無法全力施展，將林男予以不起訴。
