林益世案三法官自請評鑑　程序不符遭駁

日前判決林益世貪污無罪的台北地院法官吳秋宏、紀凱峰、林孟皇，因遭輿論痛批，三人為了自清並無偏頗，上月向法官評鑑委員會請求評鑑，希望釐清三人有無《法官法》規定的「嚴重違反辦案程序規定或職務規定，情節重大」及「違反法官倫理規範，情節重大」情節。
 
但法官評鑑委員會今決議此案「不付評鑑」，也就是不符合評鑑案成立要件。
 
委員會所持理由，依據《法官法》，法官個人不得直接請求評鑑，必須由所屬機關也就是台北地院先審查三人有無上述「情節重大」事實，如果北院認定沒有，等於達到替法官澄清的目的；如果北院認定有情節重大事實，再由北院請求評鑑。
 
林孟皇表示「不放棄，會再請北院送出請求評鑑案」。
